These terms cover your use of this website and any services you buy from EORACCO. EORACCO operates remotely and works with clients in California and elsewhere. If we sign a separate written proposal or agreement with you, that document controls wherever it differs from these terms.

Prices on this website are starting prices for planning purposes. They are not a binding offer, except for the three monthly packages you can subscribe to online, which are sold at the price shown at checkout. Your final scope, deliverables, timeline and price are set out in a written proposal that we both accept. Advertising spend, platform fees, software subscriptions and other third-party costs are billed to you separately unless the proposal says otherwise.

Monthly services are billed in advance. Project work may require a deposit before we start. Invoices are due within the time stated on them. We may pause work while an invoice is overdue.

When you subscribe to a package online, your first payment, processed by Stripe, covers the first month and the one-time setup fee shown at checkout. After that, your card is charged the monthly price automatically on the same date each month until you cancel. We contact you within one business day to confirm the details and start onboarding. If, after that first conversation, the package isn't a fit for your business, we refund your first payment in full before any work begins.

You can cancel a monthly service with 30 days' written notice. We keep providing the service during the notice period, and it is billed as usual. Setup fees are non-refundable once setup work has begun. We don't refund partial months.

Marketing results depend on many things outside our control, including your market, budget, offer, competitors and the rules of third-party platforms. We do not guarantee specific results such as sales, leads, rankings, follower counts, ad approval or App Store approval.

Many services run on platforms we do not control, such as Google, Meta, TikTok, Apple and email or phone providers. Their policies, fees, outages and decisions, including suspending an account or rejecting an ad or app, are outside our control.

You confirm that you own or have permission to use everything you give us, such as logos, photos, videos, music, product claims and customer data, and that it may lawfully be used in your marketing. You are responsible for the accuracy of your offers, prices and claims, and for approving work before it is published.

When you have paid in full, you own the final deliverables we create specifically for you. Fonts, stock media, software, templates and other third-party materials remain under their own licenses. Our pre-existing tools, methods and know-how stay ours. We may show completed work in our portfolio unless you ask us not to.

Content on this website is for general information and may change without notice. Please do not copy it for commercial use or misuse the site or its contact form.

To the extent the law allows, our services and this website are provided "as is." We are not liable for indirect or consequential losses, such as lost profits or lost data. Our total liability for any claim related to a service is limited to the fees you paid us for that service in the three months before the claim arose.

These terms are governed by the laws of the State of California. Before taking any formal action, we both agree to try to resolve a disagreement in good faith by talking first.
